LHC rules oral gift requires proof of donor declaration and possession

The Lahore High Court ruled that a deficiency in providing precise details regarding alleged fraud cannot establish an oral gift. Furthermore, the court confirmed that a mutation record only documents an asserted transaction and cannot serve as proof of the original gift.
To rely on an oral gift, an individual must independently establish three key elements: the donor's declaration, the donee's acceptance, and the actual delivery of possession. The LHC also stated that the law does not allow for the reversal of burdens of proof.
The Lahore High Court subsequently allowed the civil revision, thereby setting aside the judgments and decrees issued by the lower courts. The court ultimately decreed the petitioners’ suit.
Previously, the trial court dismissed the suit in 2015. The appellate court upheld that 2015 decision in 2016.
